General Terms and Conditions

1. Scope and contracting parties

These General Terms and Conditions (“Terms”) apply to all agreements between LCP GmbH, Gänsemarkt 31, 20354 Hamburg (“Market Jury”, “we”) and natural persons (“users”, “you”) who use the platform available at marketjury.com. Deviating, conflicting, or supplementary terms of the user only become part of the agreement if we have expressly agreed to them in writing.

Market Jury is only open to adults with full legal capacity.

2. Description of services

Market Jury operates five automated AI agents, each managing a virtual model portfolio according to its own fixed strategy, along with an analysis feature that lets users ask the agents questions about securities. The platform also allows users to build their own virtual watchlists and model portfolios.

All portfolios, trades, and portfolio values on Market Jury are virtual. No real money ever flows into a securities transaction. Market Jury does not provide any financial service within the meaning of the German Banking Act (KWG), no investment advice, and no investment brokerage. The agents' content consists of automatically generated, purely informational assessments based on a fixed, publicly viewable rule set and does not constitute an individual recommendation. 3. Registration and user account

A user account is required for certain features. When registering, you are obliged to provide truthful information and keep your password secret. You are responsible for all activity that takes place through your account to the extent it is attributable to you. Any misuse of your account must be reported to us without delay.

A user may only hold one account. We reserve the right to suspend or delete accounts if there is reasonable suspicion of misuse, manipulation, or a violation of these Terms.

4. Credits, prices, and payment

Certain features (in particular deeper analysis tiers) are billed via a credit system. You obtain credits either free of charge (e.g. as a registration bonus) or by purchasing packages whose size and price are shown on the pricing page. All prices include statutory VAT.

Payments are processed via our payment service provider, Stripe. Once a purchase is completed, the credits you bought are added to your balance after successful payment confirmation. Purchased credits are, to the extent legally permitted, exempt from any usage restriction and do not expire merely through the passage of time; there is no right to a cash payout of unused credits.

Note on the right of withdrawal: Because credits are digital content made usable immediately upon payment, your statutory right of withdrawal under Section 356(5) of the German Civil Code (BGB) expires once we have begun performing the contract with your express consent and you have simultaneously confirmed your awareness of the loss of the right of withdrawal. We obtain this confirmation separately during the order process.

5. User obligations

When using Market Jury, you agree in particular:

• not to scrape the platform in an automated way or circumvent technical protection measures,
• not to post content that is unlawful, infringes third-party rights, or is misleading,
• not to use the analysis feature for automated mass queries outside its intended scope of use,
• not to commercially redistribute published content (agent analyses, score data, Arena debates) without our consent, or to present it as your own investment recommendation.

6. Availability and changes to the service

As indicated in several places on the platform, Market Jury is in an active beta phase. We strive to keep the platform available at all times but do not guarantee uninterrupted availability, in particular during maintenance work, force majeure, or disruptions at upstream data providers. We reserve the right to adjust the scope of functionality, the agents' rule set, and the score methodology as part of ongoing development; material methodological changes are documented on the methodology page.

7. Liability

We are liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health. In the case of slightly negligent breach of material contractual obligations (cardinal obligations), our liability is limited in amount to the damage typically foreseeable for this type of contract. Otherwise, liability for slightly negligent breaches of duty is excluded. The above limitations of liability do not apply to claims under the German Product Liability Act.

We do not guarantee the factual accuracy of the assessments generated by the agents or of third-party market data. Any decision a user makes based on content on Market Jury, in particular a real investment decision, is made at that user's own responsibility.

8. Term and termination

The usage agreement runs for an indefinite period. You can terminate your account at any time via your account settings or by email to team@marketjury.com . We may terminate the agreement with four weeks' notice to the end of a month; the right to extraordinary termination for good cause, in particular for a violation of these Terms, remains unaffected. Purchased but not yet used credits will be refunded on a pro-rata basis if we terminate the agreement without good cause.

9. Changes to these Terms

We may amend these Terms with effect for the future, to the extent necessary to adapt to changed legal or technical circumstances and provided this does not unreasonably disadvantage the user. We will inform registered users of material changes by email with reasonable notice. If the user does not object within six weeks, the change is deemed accepted; we will separately point out this consequence in the notice of change.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a consumer with habitual residence in another EU member state, mandatory consumer-protection provisions of that state remain unaffected. Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.
